SIFMA and the Loan Syndications and Trading Association (LSTA) provide comments to the Committee on Rules of the Judicial Conference of the U.S. on Bankruptcy Procedure 2019. While SIFMA notes that the proposed amendment to Rule 2019 satisfies legitimate disclosure concerns, SIFMA believes the proposal would beyond practical and necessary requirements, because it would compel public disclosure of a party’s most confidential and proprietary information: the date and price at which that investor purchased (and/or sold) its Bankruptcy Claims.
