David Erb
David W. Erb, graduated in 1988 from the University of Wisconsin Law School, cum laude, and is a Partner of Fisher Phillips. David is the Co-Chair of the Firm’s Financial Services Team and a founding member of the firm’s Employee Defection and Trade Secrets Practice Group. Since 2003, David has hosted and moderated a highly regarded nearly annual invitation-only conference on Recruiting Litigation in the Financial Services Industry. David has a nation-wide practice advising financial firms on the multi-faceted aspects of strategic recruiting, protection of critical business information and resources, and the development of producer transition, retirement and book acquisition programs and agreements. He is a sought after consultant on high producer team and individual transitions, as well as matters involving allegations of large-scale raiding, including one case involving over 100 financial advisors. David has been involved in litigating or consulting on hundreds of matters concerning financial advisor transition, allegations of misappropriation of trade secrets and confidential information, U5 expungement and defamation, employee raiding, and breaches of restrictive covenants, including non-competition, non-solicitation and confidentiality agreements. David also consults on the Form U5 drafting process and both consults on and represents employers and employees in regulatory matters before FINRA, state securities and insurance commissions and the CFP Board.
