Whether the federal FIRREA wire fraud statute (which has a ten-year state of limitations period) – in lieu of the anti-spoofing statute under the Commodities Exchange Act (which has a shorter limitations period) – may be applied to alleged “spoofing” (i.e., entering orders that the defendant intends to cancel before the orders are executed) by traders in the commodities futures markets.
